Judicial Watch Sues for Documents on Biden Forcing Firing of Ukraine Prosecutor

WASHINGTON—Judicial Watch announced Sept. 26 that it has filed suit in federal court seeking to force the State Department to release all official U.S. government documents related to the firing of a Ukrainian prosecutor, as demanded by former Vice President Joe Biden.

The nonprofit government watchdog’s suit was in response to the government’s failure to respond to a May 7 Freedom of Information Act (FOIA) request for:

Any and all records regarding, concerning, or related to Viktor Shokin’s investigation of Mykola Zolchevsky, and Shokin’s resignation at Ukraine’s Prosecutor General.
Any and all records of communication between any official, employee, or representative of the Department of State and any official, employee, or representative of the Office of the Vice President regarding Shokin.
Postal records confirmed that the Office of Programs and Information Services, which handles FOIA requests sent to the State Department, received the Judicial Watch request. The department didn’t respond within the time limits set by federal law, according to Judicial Watch.

The FOIA was filed after a video became public of Biden telling a Jan. 23, 2018, conference at the Council on Foreign Relations of his threatening to withhold more than $1 billion in U.S. assistance to the government of Ukraine if officials didn’t fire Shokin before Biden departed the country in six hours.

Shokin was at the time conducting a corruption investigation of Burisma, a Ukraine energy company that was paying Biden’s son, Hunter, $50,000 a month in consulting fees, according to media reports.

“I remember going over and convincing our team that we should be providing loan guarantees, and I went over to Kyiv for, I guess, the 12th or 13th time, and I was supposed to announce there was another $1 billion loan guarantee,” Biden told the conference.

“And I had gotten a commitment from [then-Ukraine President Petro] Poroshenko and [then-Ukraine Prime Minister Arseniy] Yatsenyuk that they would take action against [Shokin], and they didn’t.

“So they were walking out to the press conference, and I said, ‘We’re not gonna give you the billion dollars.’ They said, ‘You have no authority, you’re not the president.’ The president said, I said, ‘Call him.’

“I said, ‘I’m telling you, you’re not getting the billion dollars, and I’m leaving here, I believe, in six hours. If the prosecutor is not fired, you’re not getting the money.’

“Well, son of a …, the prosecutor got fired.”

The Judicial Watch lawsuit for the Biden records was announced the same day as acting Director of National Intelligence Joseph Maguire testified before the House Select Committee on Intelligence concerning his handling of a complaint filed by an anonymous federal worker described by the news media as a “whistleblower.”

The complaint was given to the Inspector General for the Intelligence Community (IGIC). It claimed President Donald Trump threatened in a July 25 telephone call to cut off U.S. military assistance if Ukraine’s then-newly elected President Volodymyr Zelensky didn’t reopen the investigation of Burisma and Hunter Biden. The complaint also claimed White House aides tried to hide call records.

Trump released the official transcript of the call Sept. 25, calling it “a nothing call,” and denying any wrongdoing in the conversation with Zelensky.

Maguire received the complaint from the IGIC, concluded it was “credible,” and gave it to the Department of Justice (DOJ). The DOJ’s Office of Legal Counsel reviewed it and concluded the allegations in the complaint failed to meet the legal definition of an “urgent concern” in the federal whistleblower protection statute and warranted no further action.

The unidentified individual who filed the complaint acknowledged that he or she did not actually hear the president’s call to Zelensky, but only learned about it secondhand from half-a-dozen White House officials. The IGIC also said there were “indicia of an arguable political bias” against Trump in the complaint.

Congressional Democrats insist Trump’s alleged threat is an impeachable crime and are moving forward with multiple investigations they claim will determine whether formal articles of impeachment should be filed in the House of Representatives.

Rep. Devin Nunes (R-Calif.), the ranking minority member of the intelligence panel, told the Maguire hearing, “What we have with this storyline is another Steele dossier. … In the Democrats’ mania to overturn the 2016 elections, everything they touch gets hopelessly politicized.”

The Steele dossier is the discredited document that was investigated in the two-year probe, which found no Trump/Russia collusion. The dossier had been paid for by Trump’s 2016 opponent, former Secretary of State Hillary Clinton and the Democratic National Committee.

The White House released the transcript from the July phone call between President Trump and Ukrainian President Volodymyr Zelensky. During the call, the presidents discuss the aid provided to Ukraine and the lack of support Ukraine receives from the European Union.President Trump offered his sympathy for the removal of the Ukrainian prosecutor, who investigated the company of Joe Biden’s son — Hunter — and recommended looking further into the matter. At no point in the call does President Trump offer something in exchange for an investigation.Ukraine’s president responded in the call by saying he is more than happy to help his new ally. He then called President Trump a great friend.

In an early tweet Wednesday, President Trump questioned whether Democrats would apologize once the transcript was released.

Republican National Committee Chairwoman Ronna McDaniel on Tuesday called on former Vice President to release transcripts of his calls with Ukrainian and Chinese leaders. Biden is accused of pulling strings for his son, Hunter, to benefit a Ukrainian oil company whose board he sat on.

Democrats have argued President Donald Trump abused his political power and powers of office by asking Ukrainian President Volodymyr Zelensky to investigate the Bidens for alleged corruption. 

"First it was the Russia hoax. Now it’s the Ukraine hoax," McDaniel said in as statement. "Once again, Joe Biden has shown he is just as extreme as the rest of the 2020 Democrats who are desperate to bring President Trump down. Instead of backing a baseless impeachment effort, Biden should be answering for the only scandal that exists: Why a corrupt Ukrainian company paid his son $50,000 a month to lobby the Obama-Biden administration, and why Biden threatened the Ukrainians if they failed to fire a prosecutor investigating the company."

President Donald Trump announced on Tuesday that he plans to release a full, unredacted, unclassified transcript of his call with Zelensky. Now, the RNC expects Biden to do the same.

"Now that the President has authorized the release of the transcript of his call with President Zelensky, we call on Biden to release the transcripts of his calls as Vice President with Ukrainian and Chinese leaders while his son was conducting shady business deals in those countries."

Although Trump agreed to release the transcript, he did express concerns about the precedent it would set. In the future, he could be expected to release transcripts of conversations with other foreign leaders.

In an awkward interview on the campaign trail in Iowa, 2020 Democrat hopeful Joe Biden refused to explain how he’d be a more effective president on economic issues than Donald Trump.
Further demonstrating his ineptitude and mental decline, Biden appeared unable to tout his economic platform on Monday, instead opting to “let the people decide.”
The reporter pointed out that Iowa’s economy is booming under Trump before asking, “Why should people want to make a change?”
Reporter on the good economy: "Why should people want to make a change though?"

Biden: "Well that's up to them to decide"

Reporter: "Why should they?"

Biden: "That's for them to decide"

Reporter: "Well, make your case."

Biden: "I'm not going to"

“Why should they?” the reporter pressed.
Biden repeated, “That’s up to them to decide.”
The reporter, trying to help, said, “Well, make your case.”
Rather than leap at the opportunity to lay out his economic message, Biden instead shut down.
“I’m not going to,” he said.
To Biden’s credit, he could just be tight-lipped about his plan to deindustrialize America, claiming earlier this month that he would wipe out “all fossil fuel.”
His campaign staff are probably feeling pretty confident right now!

In other words, there was no quid pro quo (during that specific phone call) offered in exchange for Trump asking Ukraine officials to investigate possible crimes committed by Hunter Biden.

But in Philadelphia, where Biden on Tuesday will be among a half dozen Democratic presidential candidates appearing at what labor union federation the AFL-CIO has billed as a “Workers’ Presidential Summit,” there are signs of cracks in Biden’s union support.
Philadelphia for Biden is not just any city. It is home to his campaign headquarters, the biggest city in his home state of Pennsylvania, and an area that has long been home to oil refineries — and their union employees. And it is just miles from Delaware, which he represented in the U.S. Senate for more than 30 years.
More than a dozen current and former union leaders and workers who spoke to Reuters recently in Philadelphia, questioned Biden’s loyalty.
In embracing calls to phase out the fossil fuel industry that many of the region’s pipefitters and steelworkers rely on for jobs, they say, the former vice president and Democratic front-runner risks losing his “hard-hat” appeal in a critical swing state.

We Need to Talk about Joe Biden

He's unfit for the presidency.
There are two possible explanations of Joe Biden’s inability to tell the truth about things: One is that his mind is failing him, the other is that his honor is. In neither case is Biden fit to hold the office of president of the United States of America, and Democrats would discredit themselves and endanger the nation to nominate him.

Yes, yes, go ahead — “But, Trump!” etc. — and continue when you’ve completed the ritual of equivocation, and don’t think too hard about how far and in what direction that line of moral self-justification has carried the Republican party.

Joe Biden is a plagiarist and a liar, among other things. In the most recent example, detailed by the Washington Post, Biden made up a story in which he as vice president displayed personal courage and heroism in traveling to a dangerous war zone in order to recognize the service of an American soldier who had distinguished himself in a particularly dramatic way. It was a moving story. “This is the God’s truth,” he concluded. “My word as a Biden.”

But his word as a Biden isn’t worth squat, as the Post showed, reporting that “Biden got the time period, the location, the heroic act, the type of medal, the military branch and the rank of the recipient wrong, as well as his own role in the ceremony.” Which is a nice way of saying: Biden lied about an act of military heroism in order to aggrandize his own role in the story.

Like Hillary Rodham Clinton under fictitious sniper fire, Biden highlighted his own supposed courage in the face of physical danger: “We can lose a vice president. We can’t lose many more of these kids.”

If Biden here is lying with malice aforethought, then he ought to be considered morally disqualified for the office. If he is senescent, then he obviously is unable to perform the duties associated with the presidency, and asking him to do so would be indecent, dangerous, and unpatriotic.

The evidence points more toward moral disability than mental disability, inasmuch as Biden has a long career of lying about precisely this sort of thing.

The most dramatic instance of that is Biden’s continued insistence on lying about the circumstances surrounding the horrifying deaths of his wife and daughter in a terrible car accident. It is not the case, as Biden has said on many occasions, that they were killed by a drunk driver, an irresponsible trucker who “drank his lunch,” as Biden put it. That is a pure fabrication, and a slander on the man who was behind the wheel of that truck and who was haunted by the episode until the end of his days. Imagine yourself in the position of that man’s family, whose natural sympathy for Biden’s loss must be complicated by outrage at his persistent lying about the relevant events.

Why would Biden lie about the death of his wife and daughter? Why would he lie about the already-heroic efforts of American soldiers? In both cases, to make the story more dramatic, to give himself a bigger and more impressive narrative arc. That he would subordinate other people — real people, living and dead — to his own political ambition in such a callous and demeaning way counsels strongly against entrusting him with any more political power than that which he already has wielded.

Biden lies about matters great and small. He lies about his trip to Afghanistan. He lies about the death of his wife and daughter. He is wildly dishonest about his role in the Iraq War and the 1994 crime bill, landmark moments in his legislative career that later became political liabilities. And whatever the state of his brain today, he was not senile back in 1987, when he plagiarized the words of Margaret Thatcher and Neil Kinnock for his own speeches. Like his lies, his plagiarism is part of a lifelong habit: As recently as this year, he was filling out his policy papers with uncredited — stolen — material from advocacy groups.

The United States has become an empire of lies. We are governed by liars chosen on the basis of lies, and the worst partisans have begun openly to admire the lies, so long as they are skillfully constructed and delivered. The lowest among us enjoy being lied to and celebrate it. Entire political careers are based on lies — and policy initiatives, too.

But if not the serial liar Joe Biden, then whom will the Democrats choose? Elizabeth Warren, who has misrepresented her supposed Native American ancestry? Kamala Harris, who has lied about murder in order to serve her own political ends? Robert Francis O’Rourke, who cannot tell the truth for five minutes about basic and fundamental questions of public policy?

The Democrats are ready to go into November with nothing better to say for themselves than, “Our liar is better than their liar!” It is doubtful they will even be morally conflicted about that. But the nation will be worse off for it, inasmuch as democratic assumptions built on a foundation of lies must necessarily be unstable.

Joe Biden has exhausted whatever presumption of goodwill or benefit of the doubt we might have extended to him for the past 46 years. He has had his chance to show that he is a man capable of honor, integrity, and honesty — and he has failed that test at every turn. If there ever was a time for him, that time has passed. The last thing this country needs is another pathological liar in its highest office. He is unfit for the presidency in every way, and Democrats owe the country better than to nominate him in the pursuit of their own selfish partisan interests.
